The integration of technology into healthcare has been both revolutionary and inevitable. From wearable fitness devices and AI-powered diagnostics to telemedicine and digital health records, digital health is redefining the contours of modern public health delivery. However, this innovation has also outpaced the legal frameworks that traditionally safeguard patients’ rights, clinical ethics, and data security. As India moves toward a tech-enabled healthcare ecosystem under schemes like the Ayushman Bharat Digital Mission (ABDM), it becomes imperative to analyze the legal, ethical, and regulatory landscape at the intersection of health and technology.

The Rise of Digital Health in India

India’s push toward digital health gained significant momentum post-COVID-19. The National Digital Health Mission (now ABDM), launched in 2020, aims to provide every citizen with a unique health ID, along with a digitized longitudinal health record accessible across the healthcare network. Complementing this vision are platforms like eSanjeevani for teleconsultations and CoWIN for vaccination management. Globally, countries are embracing similar initiatives. The European Union has proposed a European Health Data Space (EHDS), and the United States is expanding interoperability rules under the 21st Century Cures Act. In this rapidly evolving ecosystem, India stands at a critical juncture where regulation must catch up to innovation.

A Fragmented Legal Framework

India does not yet have a consolidated legislation governing digital health. The regulatory framework is a patchwork, comprising the Digital Personal Data Protection Act, 2023 (DPDP Act) as the primary statute governing digital personal data, including health data, though with limited sector-specific nuance; the Information Technology Act, 2000, which governs cybersecurity obligations through Section 43A and the 2011 Rules covering sensitive personal data; the Telemedicine Practice Guidelines, 2020, issued by the Medical Council of India and later continued under the NMC; and sectoral statutes such as the Drugs and Cosmetics Act, 1940 and the Clinical Establishments Act, 2010, which apply indirectly to online pharmacies, e-health platforms, and medical devices.

However, none of these legislations provide a comprehensive, sector-specific legal framework for digital health. Crucial gaps remain, particularly regarding informed consent in digital ecosystems, interoperability standards, cross-border data sharing, and AI accountability in diagnostics.

Privacy, Consent, and Health Data Governance

Health data is inherently sensitive. Under the DPDP Act, health data qualifies as personal data, and its processing must adhere to principles of lawful, specific, and limited purpose. However, the DPDP Act removes the earlier classification of sensitive personal data and thereby weakens some of the stronger protections that had previously existed for healthcare contexts.

In practice, patients using digital health services often give consent to privacy policies they cannot meaningfully understand or control. Many platforms collect metadata and behavioural patterns beyond direct health indicators. The absence of a sectoral data protection authority, comparable to the U.S. Department of Health and Human Services under HIPAA, creates a serious deficit of oversight and enforcement. Consent, without real choice or comprehension, cannot be the backbone of health data governance.

Telemedicine, AI, and Accountability

Telemedicine is now a legal and normalized mode of consultation, but several legal ambiguities persist. There is still no express liability framework for malpractice in remote consultations. If an AI-powered tool misdiagnoses a condition, who is liable: the physician, the hospital, the technology provider, or the algorithm developer?

Internationally, the European Union’s draft AI Act treats AI used in healthcare as high risk and subjects it to stringent compliance standards. India lacks a comparable statutory framework, and the proposed Digital India Act remains at a draft stage. Without accountability mechanisms, physicians may become default scapegoats, which can discourage the adoption of beneficial technological tools in clinical settings.

E-Pharmacies, Digital Therapeutics, and Ethical Risk

The growth of e-pharmacies and digital therapeutics (DTx) is another legal minefield. Platforms such as 1mg and Netmeds have expanded access to medicines, yet the sector still lacks a dedicated regulatory framework. In 2023, the Ministry of Health issued show-cause notices to several e-pharmacies for allegedly operating without proper licenses.

The sale of prescription drugs based on uploaded photographs or unverifiable digital prescriptions raises concerns of misuse and public health harm. The Drugs and Cosmetics Rules, 1945 are outdated for the digital age and do not adequately address digital therapeutics, virtual consultations, and remote prescriptions. Legal compliance also does not guarantee ethical sufficiency. The digital divide in India means digital health risks becoming exclusionary, while algorithmic bias remains a serious concern when tools are trained on datasets not representative of Indian populations. There is also the growing danger of health surveillance capitalism, in which private companies monetize health data under the language of innovation and personalization.

Equity, bias, and accessibility remain equally serious concerns. The digital divide in India means digital health can easily become exclusionary, while algorithmic bias can distort outcomes when AI systems are trained on datasets that are not representative of Indian populations.

The Way Forward

To ensure that digital health evolves in a legally sound and ethically robust manner, India needs a sector-specific digital health law that clearly defines responsibilities for stakeholders, ensures AI accountability, sets interoperability standards, and enforces ethical data use. A centralized and interdisciplinary digital health regulatory authority should supervise certification, compliance, and grievance redressal for digital health products and services.

Algorithmic tools should be subject to regular audits and transparency obligations to check bias and fairness in clinical outcomes. Consent frameworks must become layered, dynamic, and accessible in vernacular languages so that patients understand how their data is stored, used, and potentially monetized. Public policy must also invest in digital health literacy so that marginalized communities are not left behind in this transformation.

Digital health holds the promise of revolutionizing India’s public health landscape, making care more accessible, affordable, and efficient. But this transformation must not come at the cost of privacy, equity, or accountability. The law must act as both enabler and protector, creating an ecosystem where innovation thrives alongside ethical safeguards. The time for regulatory foresight is now, before the health of millions becomes dependent on black-box algorithms and under-regulated platforms.
